NMUSD Retaliate to People reporting School Violations or Unlawful Conduct


NMUSD has continued to RETALIATE to people in District including kids, families and even their own staff, including Good Teachers when reporting school violations or policies changed unheard of by Dept. of Education. 

Why has no school official, Police Officer, District Attorney's Office investigate this further? Why did they do the same thing with the case with Mrs. Ketchum's daughter over 3 years ago?

Why does it appear to many in Community that things are hidden with Public Safety of treatment of staff to people who ask for accountability  or deserve answers?

Why is evidence supporting complaints and claims separated or tampered with appearing to Board or others like it never happen it all? Community in NMUSD believes this is Fraud to protect the School Officials unlawful actions that support school violations that create UNSAFE SCHOOL LEARNING AND WORK ENVIRONMENTS FOR SOME OF THEIR STUDENTS, FAMILIES AND EMPLOYEES.

NMUSD HAS UNLAWFUL, UNSAFE EMPLOYEES, RETALIATION NOT PROTECTED, AFTER COMPLAINTS FILED


NMUSD COMMUNITY CANNOT BELIEVE THAT ANY COUNCILMAN WOULD EVEN CONSIDER HAVING A TEACHER BE ARMED IN CLASS.

ARE YOU SERIOUS, HOW UNBELIEVABLE THAT IN NMUSD THESE TOP SCHOOL LEADERS, INCLUDING A TEACHER THAT HARMED A CHILD, BROKE SCHOOL RULES AND POLICIES AND TREATED THE FAMILY WITH NOT ONLY DISRESPECT, IT BECAME UNSAFE IN CLASSROOM FROM TEACHER TOWARDS THE STUDENT AND FAMILY WITH RETALIATION THAT WAS FEARFUL, BECAME SCAREY AND WAS SUPPORTED BY PRINCIPAL, ALL THE WAY UP TO SUPERINTENDENTS OFFICE.

THIS BEHAVIOR STEMMED FROM THE TEACHER BEING ANGRY AND UPSET THAT A PARENT, CONFIDENTIALLY REPORTED TEACHER BRINGING HER TODDLER ON CAMPUS, TO HER 5TH GRADE CLASS WHILE TEACHING AND ALLOWED SPECIAL PRIVILEGES THAT CONTINUED AFTER PRINCIPAL TOLD TEACHER PARENT ASKED WHY THIS WAS ALLOWED AND COMPLAINED.

THERE WAS NO CONCERN FOR THIS LITTLE CHILD'S SAFETY, THE UNLAWFUL CONDUCT OF TEACHER JOINED IN BY SPECIFIC DISTRICT EMPLOYEES, FALSE BLAME TO CHILD, CREATING A FRIGHTENING EXPERIENCE FOR ANY CHILD TO OBTAIN A SAFE EDUCATIONAL SCHOOL ENVIRONMENT. 

THE TOPIC NOT DISCUSSED IS SCHOOL OFFICIALS THAT ARE NOT FOLLOWING LAWS, SCHOOL POLICIES OR CREATING NEW ONES TO SUPPORT ACTIONS THAT DESTROY A CHILD, LEAVE THEM WITH SCHOOL AUTHORITIES THAT BULLY, INTIMIDATE, UNTRUSTWORTHY AND DELIBERATELY COVER FOR ONE ANOTHER WITH NEPOTISM HIRING PRACTICES. THEY KNOW THAT MOST PEOPLE CAN'T FIGHT A SYSTEM, HAVE THOUSANDS UPON THOUSANDS OF DOLLARS TO HIRE ATTORNEY, OR MAY NOT SIMPLY WANT TO TRAUMATIZE THEIR FAMILY FURTHER.

THESE SCHOOL OFFICIALS IN NMUSD HAVE DONE CONDUCT LIKE THIS FOR "YEARS AND ARE READY TO MOVE ON TO THEIR NEXT VICTIM WITH NOBODY STEPPING IN TO HELP. IT DOES NOT MATTER OF MORE STUDENTS WERE HURT OVER THE PAST SEVERAL YEARS AND THESE PEOPLE WHO TO MANY NMUSD COMMUNITY MEMBERS BELIEVE THEY SHOULD NOT EVEN BE WORKING AROUND CHILDREN AT ALL".

PEOPLE IN THIS COMMUNITY CANNOT IMAGINE THAT A TEACHER WHO'S CONDUCT WAS BEYOND INHUMANE TO A CHILD COULD POSSIBLY BE ALLOWED TO HAVE A GUN IN HER POSSESSION. IT IS SIMPLY UNIMAGINABLE AND HARD TO COMPREHEND THAT THIS MIGHT EVEN BE CONSIDERED AND WHAT HAPPENS IF THE GUN WOULD BE ASSESSABLE TO A YOUNG CHILD AND COULD ACCIDENTALLY GET SHOT. 

THE CONCLUSION IS TO HAVE MORE SECURITY DETECTION AREAS TO PROTECT PEOPLE WALKING IN AND OUT OF SCHOOLS. HAVE  CAMERA'S, AND OUTSIDE DEPARTMENTS MONITOR ANY CONCERNS LIKE DA. OFFICE, DEPT. OF JUSTICE MONITOR BOTH INSIDE SCHOOLS AND OUTSIDE SCHOOL AREAS OF THE CONDUCT OF "ALL PEOPLE", INCLUDING SCHOOL OFFICIALS THAT DO NOT UPHOLD OUR LAWS, SCHOOL POLICIES, RIGHTS OF PEOPLE, ANY VIOLATIONS  GOVERNED BY DEPT. OF EDUCATION SHOULD BE REPORTED IMMEDIATELY TO OUTSIDE NON BIAS AUTHORITIES TO KEEP EVERYONE SAFE.

KIMBERLY MIMMS, NMUSD COMMUNITY, NMUSD GOOD AND LAW ABIDING EMPLOYEE'S AND BULLYINGWARRIOR NEED YOUR IMMEDIATE HELP FROM CONGRESS, John Campbell and Congress Women Linda Sanchez WITH GREAT CONCERNS WITH THE CORRUPTION, NEPOTISM PRACTICES, RETALIATION THAT COMPROMISE SAFETY, INSTILL FEAR, DESTROY LIVES OF GOOD STUDENTS, FAMILIES, GOOD TEACHERS AND OTHERS IN NEWPORT MESA UNIFIED SCHOOL DISTRICT GOING BACK OVER 10 YEARS.

THE CONCLUSION BELOW WAS TAKEN OUT OF LETTER SENT TO THE SUPERINTENDENT, ALL BOARD MEMBERS, AND SEVERAL OTHER TOP LEADERS IN NMUSD, INCLUDED WITH OVER ALMOST 300 PAGES OF EVIDENCE E-MAILS, OTHER DOCUMENTS TO SUPPORT A 2 PART CLAIM AND NUMEROUS COMPLAINTS TURNED IN THIS SUMMER 2012.

THE 1ST CLAIM WAS TURNED IN SUMMER OF 2011 AND DENIED IN LETTER DATED 9-12-11, BY SUSAN ASTARITA, ASSISTANT SUPERINTENDENT, SUPPORTED BY DR. JEFFREY HUBBARD, NOW CONVICTED SUPERINTENDENT ON JANUARY 2012 AT CRIMINAL TRIAL IN LA. WITH THE BEVERLY HILLS UNIFIED SCHOOL DISTRICT.

KIMBERLY, OTHER CONCERNED PARENTS, TEACHERS AND FRIENDS THOUGHT IT WAS INTERESTING SEVERAL MONTHS LATER IN JAN. 2012, AFTER BOARD MEETING, MR. DAVE BROOKS, BOARD PRESIDENT NMUSD, STATED THE CLAIM WAS SEPARATED WITH NUMEROUS PAGES OF EVIDENCE. IT APPEARED THERE HAD BEEN TAMPERING WITH EVIDENCE AND FRAUD INVOLVED AT THE DISTRICT LEVEL BY UNKNOWN EMPLOYEES.

SUSAN, ALSO INCLUDED SOMETHING PUZZLING TO MANY, APPEARING TO NOW CREATE A NEW SCHOOL POLICY THAT CONTRADICTED WHAT KIMBERLY WAS TOLD FOR MONTHS BY DISTRICT, PRINCIPAL, BONNIE SWANN, DEPT. OF EDUCATION, LA UNIFIED SCHOOL DISTRICT, BEVERLY HILLS UNIFIED SCHOOL DISTRICT, THAT INDEED IT WAS AGAINST SCHOOL POLICY FOR ANY EMPLOYEE TO BRING THEIR CHILD ON CAMPUS OR INTO CLASS WHILE TEACHING OR WORKING. SUSAN WAS ALSO EMAILED MONTHS PRIOR ON 3-30-11 THAT THIS SCHOOL POLICY VIOLATION WAS BEING DONE BY TEACHER. WHY WOULD SHE MAKE UP ANOTHER POLICY MONTHS LATER AND NOT SIMPLY DONE IT AT THAT TIME?

THE REAL QUESTION IS WHY WOULD ANY SCHOOL DISTRICT SUPPORT TREATMENT OF NOT KEEPING AN ELEMENTARY CHILD SAFE FROM RETALIATION, EQUAL EDUCATION, FREE OF FALSE BLAME, DEMEANING CHILD, NAME CALLING, BULLYING, INTIMIDATION ACTIONS, LEAVE CHILD AT FIELD TRIP UNATTENDED WITH A FEW OTHER STUDENTS FOR AWHILE.

ADDITIONALLY, WHY WOULD THIS TEACHER HOLD THIS CHILD AFTER SCHOOL WITHOUT CAUSE MAKING CHILD CRY HYSTERICALLY WHEAS THEY COULD NOT EVEN SPEAK WORDS TO PARENT ON PH. AND BEING PAGED ON INTERCOM THROUGHOUT CAMPUS, (NOTE: THIS TEACHER HAD DONE THIS TO ANOTHER MUCH YOUNGER CHILD, YEARS EARLIER, MISSING BUS AND MISSING ON CAMPUS PRINCIPAL STATED NOT RESPONSIBLE WHEN PARENT GOT CALL FRANTIC WHERE CHILD WAS SHOCKED AT WHAT SHE WAS TOLD).

WHY WOULD ANY TEACHER ALSO INTENTIONALLY EMBARRASS A CHILD IN FRONT OF CLASS OR THROUGHOUT CAMPUS, NOT GIVE PROPER SCHOOL TOOLS WITH SCHOOL PAPERS LIKE OTHER CHILDREN WHEN ATTENDING OTHER CLASSES, THEN TOLD TO LOOK FOR PAPERS WHEN NEVER GIVEN IN THE 1ST PLACE, CANCEL NUMEROUS TESTS ON THIS CHILD ONLY, NOT TAKING LUNCH HOURS AT TIMES, OR MADE TO SIT IN FRONT OFFICE IN CHAIR AFTER SCHOOL TO RETAKE TESTS, KNOWING TEMPORARY MEDICAL ISSUES AT THE TIME?

SCHOOL LEADERS NOT STEPPING IN TO PROTECT CHILD, BUT RATHER INTIMIDATE, BULLY AND ADD MORE RETALIATION, NEPOTISM PRACTICES BETWEEN AFFILIATIONS OF DISTRICT EMPLOYEES.

WHY WAS THEIR SPECIAL TREATMENT BY PRINCIPAL FOR THIS TEACHER ONLY AND FOR VIOLATING SCHOOL POLICIES, NOT UPHOLDING THEM UNDER THE SCHOOL HANDBOOK AND SCHOOL POLICIES CODES?

VICTIM'S DAUGHTER, KIMBERLY MIMMS, OTHER CONCERNED KIDS, FAMILIES, STAFF, GOOD TEACHERS IN DISTRICT AND OTHERS ACROSS COUNTRY WERE HOPEFUL WITH WHAT THE NMUSD DISTRICT WOULD DO WHEN IT CAME TO ACCOUNTABILITY TO HURTING A CHILD WITH MALICIOUS INTENT AND RETALIATION SUPPORTED UP TO SUPERINTENDENTS OFFICE, UNDER JEFFREY HUBBARD AND STAFF.

PARENT WAS PERPLEXED WHY HER CHILD'S 5TH GRADE TEACHER LAST YEAR 2011 WAS ALLOWED TO BRING HER BABY/TODDLER ONTO CAMPUS AND INTO THE CLASSROOM WHILE TEACHING HER CLASS FOR MONTHS. PARENT REPORTED CONFIDENTIALLY TO PRINCIPAL WHY THIS WAS BEING ALLOWED, PRINCIPAL TOLD TEACHER PARENT'S CONCERNS, TEACHER RETALIATED NEXT BUSINESS DAY TO CHILD, TEACHERS CONDUCT AND BEHAVIOR TO CHILD NEVER STOPPED.

KIMBERLY'S CHILD WAS NOW PUT IN A UNSAFE CLASSROOM ENVIRONMENT. TEACHER'S ANGER AND DISAPPOINTMENT TO NOT BE ABLE TO BRING HER TODDLER ANYMORE TO CLASS WAS EVEN REPORTED TO ENTIRE CLASS VOCALIZING HER ANGER IN HER VOICE.

STUDENTS WERE CONCERNED OF THE TREATMENT OF KIMBERLY CHILD AND SOME OTHERS STUDENTS TOO. THE TEACHER'S ACTIONS IN CLASSROOM SETTING WITH RAISING HER VOICE ALOT, NAME CALLING, TEACHER CRYING IN CLASS APPEARING AT TIMES TO MANIPULATE KIDS AND AT TIMES TELLING THE CHILDREN NOT TELL YOUR PARENTS CERTAIN THINGS TEACHER STATED IN CLASS. THIS WAS ALARMING TO SOME PEOPLE WHO DID NOT SUPPORT ANY ADULT OR TEACHER KEEPING SECRETS FROM THEIR PARENTS. WHY WOULD A TEACHER DO THIS IN THE 1ST PLACE?

Additionally, I WAS TAKEN BACK WHEN I LOOKED AT the E-MAIL DATED 6-14-11 that I did not realize until a few days ago that was sent to EVERYONE FROM THE VERY BEGINNING OF WHEN I SPOKE AT THE BOARD THAT EVENING AND CONTINUED TO SPEAK TO YOU OVER THE PAST YEAR. A BOARD MEMBER EVEN SAID "YOUR STORY DOESN'T MAKE SENSE" after a board meeting and another board member asked me to condense my story into 1 sentence, I have been telling my story all along with the ENTIRE BOARD, JEFFREY HUBBARD, SUSAN ASTARITA, BONNIE SWANN,

BULLYINGWARRIOR SHARES NEWS ALERT: NMUSD NOT KEEPING THEIR KIDS SAFE..................................................

Note: This was turned into the entire board, Superintendent, Paul Reed, Deputy Superintendent and several other School Officials not protecting child and Family after reporting a 5th Grader Teacher bringing her toddler onto campus and into the classroom while teaching month after month included in another claim submitted this summer 2012. This was 1 of the closing statements in a letter sent in claim.

Bullyingwarrior and NMUSD Community is asking their District is there Different


Where can a child, Parent, Good Teacher go in their Community when reporting unlawful acts, school violations broken or changed when they can't trust their school District like what is happening in Newport Mesa Unified School District.

American citizens should all have a voice to be heard and Government Agencies should step in to help if a School District has a long track record of unlawful conduct, school policies changing after acts are committed.

Is there one set of rules for one group and another set of rules for another?

Does it matter who you may know or who is giving special favors or treatment to put a child, family, good Teacher or good staff member in arms way?

Why would the Newport Mesa Unified School District not want to follow their own rules they have taken an OATH TO PROTECT AND FOLLOW, including Government Regulations, School Policies, Constitutional Laws, School Handbook Policies, Civil Laws or just simply treat people with dignity and respect?

Another story uncovered by Sarah shared by Bullyingwarrior is concerning an ELEMENTARY SCHOOL YOUNG BOY. Why in October 2012 was another child held in Office for hours and in trouble for drinking tea.

WHAT IS HAPPENING WITH THE NEWPORT MESA UNIFIED SCHOOL DISTRICT HURTING MORE KIDS IN THEIR COMMUNITY?

FIRST, IT WAS A CHILD AT NEWPORT HEIGHTS ELEMENTARY SCHOOL IN 2011 AFTER REPORTING 5TH GRADE TEACHER BRINGING HER BABY/TODDLER ONTO THE CAMPUS AND INTO HER CLASS WHILE TEACHING FOR MONTHS. SCHOOL POLICIES WERE BROKEN AND SUPPORTED BY DISTRICT KNOWING RETALIATION IMMEDIATELY FOLLOWED CHILD IN CLASS WITH FAMILY THAT REPORTED IT TO PRINCIPAL AT THE TIME.  
HOW CAN SUSAN ASTARITA MONTHS LATER ON 9-12-11 CREATE NEW SCHOOL POLICY IT NOW WAS OKAY FOR TEACHER TO DO THIS. INTERESTING TO NOTE SUSAN ALREADY HAD EMAIL BACK ON 3-30-11. SUPERINTENDENT'S OFFICE EMPLOYEE BONNIE SWANN CONFIRMED IT WAS AGAINST SCHOOL POLICY, PRINCIPAL AT THAT TIME CONFIRMED THE SAME AND EVEN DEPT. OF EDUCATION SAID IT WAS AGAINST ALL SCHOOL POLICIES.

Below is the official press release from the Newport-Mesa School District regarding the story posted yesterday about the elementary school boy suspended from school for having kombucha tea in his lunchbox which school administration deemed with no testing or due diligence to violate the district’s drug and alcohol policy.

It appears that the school must fear the legal ramifications of their over the top reaction as they are spinning the story already.

The statement insists that the child was not suspended and no disciplinary action was taken.


You call keeping a child in the school office for the entire day, interrogating him about where/when he obtained this “illegal” beverage, telling him he may have to transfer to another school, attempting to sign him up for a youth alcoholics program and then having him sign a 5 day suspension notice “no disciplinary action?”  

Revoking the suspension does NOT mean the suspension and interrogation somehow never happened!   And, Police Officers in uniform (per a statement from the child’s mother who had another meeting yesterday – this time with the Principal) were called into the office to assist with the child’s possibly illegal interrogation since the child was questioned about any medicines he was taking etc and there was no attorney or parent/guardian present.  Whether or not the officers were already on campus is immaterial.

I do hope the parents consider legal action to be played out in a court of law.  A very strong possibility exists that their rights and that of their son were horribly violated and doing nothing just ensures that this type of abuse will continue.

Newport-Mesa Unified School District’s Statement Re: Alleged Action of Suspension for Possession of Kombucha Tea Drink

For Immediate Release: Friday, October 12, 2012

Newport-Mesa Unified would like to respond to a recent article posted in The Healthy Home Economist titled, “Child Suspended from School for Kombucha in Lunchbox.”

No disciplinary action was taken and the student was not suspended. The parents of the involved student met with the school principal to discuss and resolve any issues that resulted from Wednesday’s incident.

The issue resulted from the student being in possession of a beverage called, Kombucha, a tea, which states on its label that it contains 0.05 percent alcohol. The substance came to the attention of school officials through other students who reported that a student had alcohol. Having a substance on campus containing any level of alcoholic content is a violation according to District policy.

The article also references police involvement. The Newport Beach Police Department provides two full- time School Resource Officers who work with our Newport Beach and Corona del Mar campuses. Police were not called in specifically for this incident. The SRO was already on campus and participated in a routine discovery process. All this being said, the incident itself and the perception of how it was handled is something the District is committed to correcting. School districts implement policies and procedures to ensure consistency of practice. For most circumstances, the practices work. However, this was a new situation.

Seeing the need to review some of the practices regarding policies and procedures regarding discipline, the Newport-Mesa Unified School District Board of Education has requested the Superintendent to research programs that would emphasize a more nurturing approach to the discovery process and avoid overly aggressive practices when dealing with the discipline process.

Another complaint written and emailed.  A Claim was filed August, 2011 another claim filed in Summer 2012 in 2 parts with evidence tampering from the beginning claims, pulling critical records supporting claim AGAINST JEFFREY HUBBARD, SUPERINTENDENT AND SUSAN ASTARITA, ASSISTANT SUPERINTENDENT AND OTHERS ON  July 25, 2012, these claims were also REJECTED.

It stated under Background-"Claimant alleges insufficient responses by District. The District disputes this allegation".
(Note District Attorney of OC received Copies of this claim and Family and NMUSD Community and others across the county are very interested in what their own investigation discovers. Family is hoping the Department of Justice will step in to help assist the Fraud, not keeping a child safe in their educational environment and the unequal, bias, nepotism practices that directly impacted all the NUMEROUS COMPLAINTS AND CLAIMS FILED IGNORED THROUGHOUT THE ENTIRE PROCESS AND DELIBERATELY TRYING TO NOT PROTECT THE STATUTE OF LIMITATIONS ASSOCIATED WITH ACTIONS THESE SCHOOL OFFICIALS WERE TAKING UNDER OUR LAWS AND CONSTITUTION.

Why would any school official allow kids and Parents feel helpless, fearful, afraid in reporting these actions after seeing the major retaliation, harm to their children, feeling like to leave school district, Good Teachers and Staff leaving their careers or positions and empowering these Top Officials to move on the their next victims.

Kimberly, has been speaking out for other to have voice by attending Board Meetings sharing their own heart breaking experiences with this District that go back over 10 years, besides her own story. Kimberly reported confidentially to Principal her child's 5th grade Teacher allowed to bring her baby/toddler into the classroom while teaching in public school month after month, 2010/2011 at Newport Heights Elementary School, in Newport Beach, CA.

 Again, at end of meeting about young man accused of drinking at school 2 weeks before he was graduating. He did nothing wrong and was expelled from school for false blame, even though numerous kids and Teachers spoke up for this student and Parents spent almost $11,000, Attorney fee to walk down the aisle for graduating, even with Board and evidence the student even said I will take a DUI Test to prove I was not drinking and have done nothing wrong. The District refused, even as the Student went before Board with Teachers being witnesses and letters from students, after leaving student quickly receive call from District that he could NOT GRADUATE AND PULLED HIS NAME OFF ALL GRADUATION INFORMATION GOING OUT TO PUBLIC. THIS STUDENTS SCHOLARSHIPS WERE LOST AND THERE EVEN WAS RETALIATION TO HIS BROTHER, AND ESPECIALLY HIS SISTER IN LOWER GRADE CLASSES AT SAME SCHOOL. This is a tragedy, injustice to destroy a Young man life ahead of him and College goals and dreams.

Kimberly also brought a tape recorder in to Board Meeting and played it that was left on Walt Davenport's phone number on 6-14-11 when Dept. of Education encouraged her to go to Board Meeting same day, e-mails were also sent to each Board Member, not realizing months and months later they were included the entire time and appeared to not understand what happened.

The Board made derogatory remarks that the tape was not Parent etc. Parent said something like you already had all this information(THE RECORDING WAS ON 6-14-11, THE SAME DAY KIMBERLY SPOKE FOR THE 1ST TIME RECOMMENDED BY DEPT. OF EDUCATION WHICH CAN BE VIEWED UNDER YOUTUBE: BULLYINGWARRIOR OR UNDER BULLYINGWARRIOR FAVORITES UNDER THE DATE ORDER). Further it was known to Superintendent, Assistant Superintendent, Principal at the time and supported by these employees, knowing fully it became unsafe learning environment, unequal education and not supporting child's educational success by this Teacher upset that her child could not come to campus and classroom anymore, even though she still brought her child a few more times. Parent was so FEARFUL, KIMBERLY DID NOT KNOW WHAT THESE SCHOOL OFFICIALS WOULD DO NEXT TO HER CHILD WHEN DRIVING AWAY FROM THE SCHOOL, STATED IN BOARD MEETING.(Youtube Bullyingwarrior under 11-27-12

Principal joined in and select group who supported Teachers conduct, including front office employee running this "special free childcare for this 1 Teacher only, sometimes leaving her own position in front office taking toddler back and forth back to Teachers class or set child up on front computer.

Reporting complaint to Susan Astarita in e-mail on March 30, 2011, was ignored by the unlawful actions of Teacher. It was followed up by Bonnie Swann, (months later the Principal got rewarded with promotion to take over Bonnie's position when she appeared to retire early, in some people's opinion) under Susan and things only became worse and numerous scheduled test or make up tests and grades were not entered correctly at times or grades delayed to this child only continued.

Kimberly brought out in Board Meeting on 12-13-11 the Pattern of Behavior and had already dealt with Susan, Bonnie and Jeffrey Hubbard when her child was only 7 yrs. old in 2nd grade in a school in NMUSD. Child was given a hard time to use bathroom and get water, due to food poising. Parent spoke with Principal and Teachers were relentless to hurt child emotionally, put child in back of room isolated away from others. Family doctor stepped in to help and told Parent to get child out of the unsafe school, which she did. It was brought out in this Board Meeting in Dec. 13, 2011 and was EDITED OUT WITH ANOTHER PARENT, A TEACHER AND EMPLOYEE AT THE TEACHER FEDERATION WAS TAKEN OUT TOO FOR ALMOST 2 MONTHS WHEN KIMBERLY CALLED DISTRICT AND NOTIFIED THEM. THEY VIOLATED THE BROWN ACT AND WITHHELD THIS BEFORE, DURING AND AFTER THE TRIAL OF JEFFREY HUBBARD. KIMBERLY OBTAINED A COPY WAY BEFORE THIS AT DISTRICT WHEN THEY WERE STATING 1ST THERE WAS A GLITCH, AND THEN LATER SAID THE CORRECTED VERSION IS COMING OUT. KIMBERLY ASKED FOR A COPY OF THE ORIGINAL DVD RUNNING PREVIOUSLY, DISTRICT STATED IT NOW WAS DESTROYED, KIMBERLY ASKED NOW THE CORRECTED VERSION WAS TAKEN OFF WEBSITE IT APPEARED TO BE MISLEADING TO THE PUBLIC, ESPECIALLY WHAT OTHER PEOPLE SAID ABOUT JEFFREY HUBBARD AND KIMBERLY GIVING A FORMAL NOTICE TO HIM NOT KEEPING HER CHILD SAFE AND IT HAD NOT BEEN THE FIRST TIME.

Note: It was interesting that Kimberly and Community saw a photo of an employee in question in the LA Trial standing by video equipment at NMUSD site. It made People question what employees had access to specific areas in District Offices that DVD problems arose during the time before the trial, of Jeffrey Hubbard and how the meeting on 12-13-11 appeared to have been tampered with in some way. Not only was it a Violation with Brown Act, but how did Kimberly obtain a copy from District that was not "broken", and already being handed out to the public and out on Youtube?

KIMBERLY ASKED DISTRICT SEVERAL MONTHS LATER WHAT HAPPENED TO COPY?  SUPERINTENDENTS OFFICE STATED THE TAPE WAS BROKEN. Kimberly knew it was not because the District had previously given her a copy that was fine including the public input area was in it not taken out. It was passed out in the meeting on Jan. 24, 2012 even given to Mrs. Ketchum when she spoke about NMUSD Officials and Board Members not keeping her child safe her high school year at CDM, when 3 athletes threatened to rape, murder her child and posted something on Facebook about it.

Why would these Employees either retaliate, bully, intimidate child and Family? Why would others create false blame, harmful actions or others not step in and do their job protecting child and family? Additionally, after the family felt they were run out of unsafe district and submitted 1st claim in August 2011.

Susan Astarita created on 9-12-11 a New School Policy that now the Teacher had been allowed to bring her child onto campus and into classroom, supported by Jeffrey Hubbard, Superintendent at that time. Why was Parent not told months earlier that it was okay when they all stated it was against School Policy? This was unheard of stated by Department of Education when Parent called and sent e-mails.

CHILD PAGED ON INTERCOM AND other PARENT CAME OVER AFTER SCHOOL TO MAKE SURE CHILD WAS ALL RIGHT. FRONT OFFICE WORKER STATED THEY DID NOT NEED TO TELL ME WHAT HAPPEN OR WHY CHILD HAD TO STAY WHEN STUDENT WAS CRYING HYSTERICALLY AND COULD NOT EVEN SPEAK WORDS WHEN THE MOM CALLED ON PHONE. TEACHER EVEN STATED TO CHILD, CRYING WON'T HELP YOU.

Kimberly stated in Board Meeting on September 11, 2011 that she was holding Dave Brooks responsible, President and retired Police Officer in CMPD.                                         Note: Board Meeting on 1-24-12 Dave Brooks  walked with  Mrs. Ketchum and me outside with Mr. Brooks permission to do so. People were upset knowing the background of Mr. Brooks as a Police Officer. Shortly thereafter, Mrs. Ketchum left. Mr. Brooks stated something like your story doesn't make sense I asked him why he would state this.

Re: Free Child Care Offered previously last year and into Feb.2011, by Newport Heights Elementary School in Newport Beach, CA. by Front Office Manager, only given to 1 particular teacher on tax dollars and school funds wasted for personal use, horrific retaliation for reporting confidentially to Principal, including taking away my child and myself First Amendment Rights.


My daughter WHO IS 12 year old is my HERO, WARRIOR and inspiration concerning BULLYING FROM TOP SCHOOL OFFICIALS, PRINCIPALS AND A TEACHER AND SUPERINTENDENT's OFFICE. MY FAMILY HAS TAKEN A STAND TO HOPEFULLY CREATE A NEW LAW, PENAL CODE OR HAVE ACCOUNTABLILITY FOR UNLAWFUL ACTIONS AT THE NEWPORT MESA UNIFIED SCHOOL DISTRICT IN CALIFORNIA, run by Superintendent Dr. Jeffrey Hubbard who has been in the news for fraud previously and currently again. Please look into the following points and help my family make sure nobody else goes thru a Nightmare to stop Bullying from Top School Officials:


1. Board and Superintendent’s Employees did nothing to protect my child on unlawful practices and things got worse on 6-14-11 after reporting it in the Board meeting, for your review, at the NMUSD that Superintendant Jeffrey Hubbard works in. Toggle to 1 Hour 42 min. into meeting to hear my concern and additional complaint. I felt Bullied, defeated, helpless to protect my daughter at a unsafe educational environment and this Teacher treated my child inhumanely, was cruel, provided unsafe classroom with not Equal Education for my daughter and much more.

2. In addition this teacher was calculating using her School loop to provide fraud and discrimination to my child only on Thursdays to take redo/tests. The teacher when I pointed out what was going on and it was stated that Thursdays were indeed a test or redo day, she pulled it off her site soon after and changed it like it was never there to begin with, with the full support of this past Principal, now working at the school district, under Susan Astarita, Superintendent. The teacher was using the computer school loop to directly hurt my family and makeup test days.

3. There was even more manipulation with children in classroom when the teacher cried often in front of students for her own agenda, coming in late where as children in the mornings were left alone at times when a teacher had to go back to her own classroom to teach. This teacher would tell my child and class not to tell your parents this or that, encouraged students to have secrets from parents for the teachers own gain. Additionally, asked class what the days were agreed on with redo test taken, which had always been Mon., Tues., and Thurs., XXXXX, a student raised his hand when called on from teacher. The teacher said no it is not on Thursays only on Mon. and Tues. NOT Thurs. the Principal changed it, to cover up and support the discriminatory injustices to my child only. Why did teacher cancel numerous tests on my child knowing that time and money were being spent on a private tutor, who also stated in an email you are doing an injustice to the
Mimms family addressed to the School Official. The teacher's injustice actions reflected retaliation towards me reporting school district violations and took it out on my child and family, with full support of the Principal and Superintendents office knowing the whole time and do nothing to protect my family.


4. In addition, the extra time my daughter was putting in studying over and over again,with a private tutor, simply to have the test canceled on my child numerous times. Note: When school ended already, I was given a incomplete file on my daughter that even stated in a group meeting that Thursdays was indeed a makeup day set up by teacher and confirmed by Principal with witnesses and School employees in attendance, evidence supporting the continued FRAUD and cover up actions of these School officials. It took over 2 months to receive my childs school file with incorrect records on a test pulled out years ago because of inacurate content and documentation. The records only reflected the same school district, same District employees wrongful actions and turning things against a parent and child only trying to support the education from 2nd grade and my childs doctor letter gone from the file that stated the school/district was not supporting a child and parent.


5. Principal told Teacher I confidentially complained, and then Teacher announced to my child’s 5th grade class that she was upset, angry that “a parent in here complained that my son cannot come into class anymore”, broke confidentiality with horrific repercussions, discrimination, verbal abuse, First Amendment Rights taken away from Principal, Teacher with Superintendents office protecting their illegal actions.


6. Reporting these Unlawful and Unjust actions to Board and Superintendents office made it more of a Nightmare, unsafe educational environment for my child and for a parent only supporting their child educational success. These School officials have done nothing to look into these Unlawful acts against a child and parent and is still being ignored or covered up. My daughter still asks me "Mommy aren't the laws set up to protect and help children and people?
Thank you in advance for your help, reviewing my complaints, emails and review when I spoke 2 times at the Newport Mesa Unified School district board meeting.Click on June 14th toggle or fast forwarded in to 1Hr. 42 min,in spoke after Union President spoke. (Discussed Bullyiing from Top School Officials and Spoke for People that were too scared to come forward or had no voice.....
Second time spoke on October 25 toggle fast forward to 1Hour 4min. 32sec. spoke for almost 11 min.


In closing I will write what I closed with on Oct. 25 in the Board Meeting:
People in our schools, workplace and world should be COLORLESS, not Prejudice. It should not matter where we live, if we rent or own, what we drive, how many degrees we have, what language we speak, if we are single parents, married parents, step parents, foster parents, adopted parents, grandparents, same sex parents. We all should live by supporting one another, our precious and incredible children. All have Equal Education, safest environment for learning and reach out and make a positive difference and be the best role model to others.


What an incredible world it would be and school district, if we only did unto others the way we want to be treated, hopefully with Dignity and Respect at all times.
I appreciate you caring enough to take your valuable time for All the People, Good Teachers, Staff, Parents, especially our precious Children and the new Laws, Penal Codes, you have created or will continue to create for our future generation. Why did Susan Astarita, Assistant Superintendent deny complaint on 9-12-11 in letter stating it was more beneficial for this teacher to bring baby/toddler to class/campus then to have teacher miss school. This is unlawful and even a Mayor I met with recently stated his daughter in same district who teaches 5th grade cannot do this. Why this teacher and they should have stated this from the very beginning, right? The Board member, Mrs. XXXX sent me email stating she did not receive a copy of the denial complaint, but the board members and Superintendent voted on the denial letter. How could this get done with the Board member not receiving not only the letter, but my complaint information, email evidence and
handwritten notes that were submitted in August 2011? It does not appear legally right what has happened in the complaint process and seems like people are not being straight forward on correct protocol according to school policies and educational law.

BULLYINGWARRIOR NEWS ALERT: SHARES THE REAL STORY IN NMUSD ABOUT JEFFREY HUBBARD, NOW PAST CONVICTED SUPERINTENDENT AND OTHER STAFF, INCLUDING SUSAN ASTARITA, ASSISTANT SUPERINTENDENT,  CREATING NEW SCHOOL POLICY UNHEARD OF FROM DEPT. OF EDUCATION AND OTHER SCHOOL DISTRICTS ACROSS THE COUNTY.

WHY NOT KEEP KIDS, FAMILIES, GOOD TEACHERS, STAFF SAFE WHEN COMING FORWARD IN REPORTING UNLAWFUL ACTS TO A CHILD,  COMMUNITY MEMBERS IN SCHOOLS, GOOD TEACHERS WHO MAY BE BULLIED BY ANOTHER TEACHER OR PRINCIPAL, IT CAN EVEN BE A GOOD BOARD MEMBER BULLIED BY A SUPERINTENDENT LEAVING FEAR AND INTIMIDATION BEHIND.

WHY DID THE DISTRICT NOT FOLLOW UP WITH THE REPORT WITH AN EMPLOYEE DRINKING ON THE JOB? IT WAS NOT SAFE FOR THE KIDS AND STAFF BACK IN 2007 AND RETALIATION FOLLOWED THE EMPLOYEES THAT REPORTED THESE ACTIONS,  AND THEY RESIGNED.

DID IT NOT MATTER TO NMUSD WHEN THEY FAILED A YOUNG WOMEN NOT PROTECTED AT CDM BY THREATS OF RAPE AND MURDER BY 3 ATHLETES? WHY DID THEY NOT TAKE A STAND TO HELP THIS YOUNG WOMEN?

WHAT HAPPENED TO THE YOUNG CHILD AT NEWPORT HEIGHTS ELEMENTARY SCHOOL NOT PROTECTED AFTER FAMILY REPORTED 5TH GRADE TEACHER BRINGING HER TODDLER ONTO CAMPUS AND INTO THE CLASSROOM WHILE TEACHING. WHAT HAPPENED TO THE SAFETY TO NMUSD STUDENT AND FAMILY LAST YEAR WITH INHUMANE TREATMENT FROM "BULLYING FROM TOP
SCHOOL OFFICIALS."
THERE WAS A DISTRICT EMPLOYEE THAT CAME FORWARD AND SAID DISTRICT HAD  FAMILY AND "SPECIAL FRIENDSHIPS  PROTECTING CORRUPTION WITH NEPOTISM HIRING PRACTICES, THAT WERE UNFAIR AND BIAS TO STUDENTS, PARENTS AND OTHERS.

OPEN TRANSPARENCY SHOULD BE A CHOICE OF COMPLAINANT FOR AWARENESS IN SCHOOLS, WORKPLACE ESPECIALLY IF THERE ARE SIMILAR COMPLAINTS ON THE SAME EMPLOYEE. JUST LIKE THERE IS SIMILAR INFORMATION ON CHILDREN WITH PINK AND BLUE CARDS THAT COULD EFFECT THE NEXT GRADE LEVEL WITH A NEW TEACHER. THE NAMES OF PEOPLE DO NOT NECESSARILY HAVE TO BE USED.  EVERYONE SHOULD BE ACCOUNTABLE FOR THEIR ACTIONS, INCLUDING KIDS, PARENTS AND ALL DISTRICT EMPLOYEES.

NMUSD COMMUNITY SUPPORTS OTHERS NOT BE AFRAID OF THESE PEOPLE AND THE MEASURES THEY GO WITH OVERSTEPPING POWER, RETALIATION IN THEIR "GOVERNMENT POSITIONS".

PLEASE COME TO THE BOARD MEETING IN NMUSD TUESDAY, DECEMBER 11, 2012 AT 7:00PM AND OBSERVE WHAT HAPPENS IN THE PUBLIC INPUT 2 AREAS WITH THE COMPLETE STORY OF DISTRICT EMPLOYEES THAT THINK THEY ARE ABOVE THE LAW. CHANGE NEEDS TO PLACE WITHIN OUR DISTRICTS AND CA. Dear Dr. Hubbard,
Please review the following e-mails and I hope and pray you will investigate these formal complaints and they will be taken very seriously concerning the actions and behavior of some of your staff, teachers, at Newport Heights and your staff at the school district, especially XX. XXX, and your past employee XXXX XXXX. I look forward in great anticipation, faith that you will not ignore the behavior of these people and the conduct of a teacher at Newport Heights Elementary, Mrs. xxxxxx. Please review my e-mails and follow up with me at your earliest convenience. Children are being emotionally hurt, by the conduct of this teacher and Mrs. xxxxxis not providing a safe learning educational environment effecting grades,'not providing educational tools, schoolwork for every student, specifically my child after I reported her bringing her toddler to class for months disrupting the educational experience of my Childs 5th grade class recently.
